At Truhome Finance Limited (formerly Shriram Housing Finance Limited), a company incorporated under the Companies Act, 1956, (hereinafter referred to as “Truhome Finance Limited” or the “Company”) and You, as the customer (hereinafter referred to as “I/We” or the “Customer”),

These Terms and Conditions (hereinafter referred to as “Agreement”), constitute a legally binding agreement between the Company and Customer and set out your access to and use of the website [https://www.truhomefinance.in/] and the mobile application [https://customerportal.truhomefinance.in/login] (collectively referred to as the "Platform"), owned, managed and operated by Truhome Finance Limited. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU MAY DISCONTINUE THE USE OF THE COMPANY’S SITE IMMEDIATELY

1. I/We hereby declare that all particulars, information and details furnished in this application form are true, accurate, complete and up to date to the best of my/our knowledge and belief. I/We confirm that no material information has been misrepresented, concealed, omitted or withheld. I/We understand that certain information provided by me/us is required for compliance with applicable regulatory and operational requirements. In the event that any information provided by me/us is found to be false, inaccurate, misleading or misrepresented, I/We acknowledge that Truhome Finance Limited shall have the right to reject or cancel my/our application and take such action as may be permissible under applicable law.  Submission of a loan application through the Website does not guarantee approval of any loan or credit facility. Truhome reserves the right to accept, reject, or discontinue processing of any application based on its internal policies, credit assessment, risk evaluation, regulatory requirements, and other applicable eligibility criteria. Where required under applicable law, regulatory guidelines, or internal policy, the applicant may be informed of the primary reason(s) for rejection through appropriate communication channels. The decision of Truhome in this regard shall be final and binding.)

2. Pre-Application Enquiries and Lead Generation: Any enquiry, lead, missed call request, callback request, or information submitted through the Website or any marketing channel of Truhome Finance Limited shall be treated only as an expression of interest and shall not constitute a loan application or create any obligation on Truhome Finance Limited to provide any loan or financial product. Any information relating to interest rates, EMIs, loan amounts, eligibility, offers, or other product features communicated through the Website or marketing materials is indicative in nature and subject to change, verification, and Truhome Finance Limited's applicable policies. Final loan terms, if any, shall be determined only upon completion of the formal application process and requisite credit and eligibility assessments. By submitting my details, I/We consent to Truhome Finance Limited and its authorized representatives contacting me/us via phone calls, SMS, WhatsApp, email, or other electronic means regarding your enquiry, application, customer service, and promotional communications, in accordance with applicable laws. Unless otherwise I/We exercise my/our Right to withdraw consent and the specific non-mandated consent has been voluntarily and manually revoked by me/us through the designated portal or by contacting the grievance officer, and such withdrawal has been duly processed by Truhome Finance Limited.

3. Authorization for Verification and Information Sharing: I/We hereby authorize Truhome Finance Limited, its associates, service providers, agents and authorized representatives to obtain, collect, verify, use, process, exchange, share and disclose any information and documents relating to me/us, as may be required for evaluating, processing, administering or servicing my/our application and/or facilities.
I/We further authorize Truhome Finance Limited to contact me/us and/or obtain information from my/our employer, banker(s), financial institutions, credit information companies, credit bureaus, regulatory authorities, service providers, references, family members and such other persons or entities as Truhome Finance Limited may deem necessary for the purposes of verification, credit assessment, risk management, fraud prevention, regulatory compliance and related business requirements.
I/We consent to Truhome Finance Limited obtaining, sharing and disclosing my/our personal information, credit information and related records, including repayment history, account status, outstanding balances and default information, with Credit Information Companies, the Reserve Bank of India (RBI), UIDAI, regulatory authorities, government agencies and other persons or entities as permitted or required under applicable law.
I/We acknowledge and consent that such collection, processing, sharing and disclosure of information may be undertaken for legitimate business purposes, regulatory compliance, credit assessment, customer servicing and any other purpose permitted under applicable law.

4. I/We hereby represent and confirm that no insolvency, bankruptcy, winding-up, recovery, attachment, enforcement or similar proceedings have been initiated or are currently pending against me/us before any court, tribunal, authority or other forum. I/We further confirm that no criminal proceedings are pending against me/us that may materially affect my/our financial obligations or ability to avail of the facility. I/We also declare that I/we have not been adjudicated insolvent, bankrupt or otherwise disqualified by any court, tribunal or competent authority, and that no receiver, administrator, trustee, liquidator or similar officer has been appointed in respect of my/our assets, properties or affairs.

5. I/We authorize Truhome Finance Limited, its agents and authorized representatives to contact me/us via call, SMS, email, WhatsApp or other electronic channels regarding my/our application, customer service requirements, product offerings, promotional schemes and related communications. I/We provide my/our consent to receive such communications on the contact details provided by me/us, notwithstanding registration under any DND/NCPR registry, to the extent permitted under applicable law. I/We understand that such consent may be withdrawn at any time in accordance with applicable laws and Truhome Finance Limited’s policies.

6. I/We hereby authorize Truhome Finance Limited, its employees, agents, service providers and authorized representatives to visit my/our residence, office and/or business premises for the purpose of conducting verification, inspection, and due diligence in connection with my/our application. I/We further consent to the collection of information and the taking of photographs of the residence and/or business premises, wherever considered necessary for verification, record maintenance and assessment purposes.

7. I/We hereby authorize Truhome Finance Limited to purge the documents submitted by me/us, if the case is not disbursed / approved for whatever reason within 3 (three) months of application.

8. I/We hereby give our consent to avail information on products and services of other Companies and authorise Truhome Finance Limited to cross-sell other companies' products and services.

9. I/We acknowledge and agree that the sanction and disbursement of any facility shall be at the sole and absolute discretion of Truhome Finance Limited and shall be subject to satisfactory completion of the Truhome Finance Limited’s appraisal, verification, due diligence, and documentation requirements. I/We further agree to execute such agreements, declarations, undertakings and other documents, and to comply with such conditions and formalities, as may be required by Truhome Finance Limited from time to time.

10.    I/We understand and accept that Truhome Finance Limited reserves the right to approve, decline, withdraw or discontinue the processing of my/our application at any stage, without being obligated to assign any reason for such decision, subject to applicable law. I/We further acknowledge that the decision of Truhome Finance Limited in this regard shall be final and binding.

11. I/We hereby provide my/our consent to Truhome Finance Limited for accessing, retrieving, processing and using my/our KYC records from the Central KYC Registry (CKYCR) for customer identification, verification, regulatory compliance, fraud prevention and loan processing purposes. I/We further consent to receive communications relating to such KYC records and services through SMS, email and other electronic communication channels on the contact details provided by me/us.

12. I/We know and understand the English language well and shall prefer to have all future communications including but not limited to a copy of the loan agreement, its enclosures, notices and other relevant loan documents, in the English language only.

13. I/We hereby consent to be registered as a member on the Truhome Finance Limited (https://www.truhomefinance.in/ & https://customerportal.truhomefinance.in/login) and would like to receive information directly or indirectly about products & services of any service provider listed on said platform, through telephone, email or SMS.

14. This Agreement constitutes an electronic record in accordance with the provisions of the Information Technology Act, 2000 and the rules made thereunder. Being an electronic record, this Agreement is generated by a computer system and does not require any physical or digital signature. This Agreement is published in compliance with applicable laws governing electronic records and the use of online platforms. By accessing, browsing, registering on, or otherwise using the Platform, you acknowledge that you have read, understood and agreed to be bound by this Agreement,  Privacy Notice, Consent Terms, Disclaimer, and any other policies or guidelines that may be made available on the Platform of the Company from time to time. These documents shall be deemed to form an integral part of this Agreement and shall be read together.
Truhome Finance Limited reserves the right to modify, amend, update or replace this Agreement, in whole or in part, at any time and without prior notice, to the extent permitted under applicable law. Any such modifications shall become effective upon being posted on the Platform. Your continued access to or use of the Platform after such changes are posted shall constitute your acceptance of the revised Agreement.

15. You are encouraged to review this Agreement periodically to stay informed of any updates or changes.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING, BROWSING, REGISTERING ON OR USING THE PLATFORM, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS. YOUR ACCEPTANCE OF THESE TERMS CREATES A BINDING AGREEMENT BETWEEN YOU AND TRUHOME FINANCE LIMITED IN RELATION TO YOUR ACCESS TO AND USE OF THE PLATFORM AND ITS SERVICES.

16. Description and Acceptance of Services: Truhome Finance Limited hereby provides access to information, products, services, facilities and digital solutions relating to housing finance, loan products, customer support services, financial information, online application services and other related offerings (collectively referred to as the "Services") through the Platform. These Terms and Conditions shall apply to all users and visitors accessing or interacting with Truhome Finance Limited through its Website, mobile application, advertisements, social media platforms, digital or print publications, marketing communications, and other promotional channels, to the extent applicable.

The Services, and any ancillary services associated therewith, are provided on a commercially reasonable efforts basis. By accessing or using the Platform, you acknowledge and agree that your use of the Services is voluntary and undertaken at your sole discretion.

Your continued access to or use of the Services shall constitute your acceptance of these Terms of Use, including any amendments, modifications or updates made from time to time. These Terms shall remain binding upon you unless terminated in accordance with the provisions set out herein.

You acknowledge and authorize Truhome Finance Limited, its affiliates, group companies, service providers, business partners and authorized representatives to collect, use, process, store, share and disclose your information, to the extent permitted under applicable law, for purposes including:

• Processing and servicing your application or account;
• Customer verification and due diligence;
• Credit assessment and risk management;
• Customer relationship management;
• Regulatory and statutory compliance;
• Analytics and service improvement;
• Offering products, services and value-added solutions that may be of interest to you;
• Marketing, promotional and customer engagement activities, where permitted by law.

You further consent to receive communications from Truhome Finance Limited, its business partners, service providers and authorized representatives through telephone calls, SMS, email, WhatsApp, push notifications and other electronic communication channels regarding Services, product offerings, account-related information, service updates, promotional campaigns and other related communications.

You expressly consent to such communications being sent to the contact details provided by you, notwithstanding your registration under any Do Not Disturb (DND) or National Customer Preference Register (NCPR), to the extent permitted under applicable laws and regulations. You may withdraw or modify such consent in accordance with applicable law and Truhome Finance Limited's policies.

You further authorize Truhome Finance Limited to share your information with its affiliates, group companies, service providers, business partners, regulatory authorities, Credit Information Companies, technology partners and other third parties as may be necessary for the purposes stated above or as otherwise required or permitted under applicable law.

Truhome Finance Limited shall retain and process your information for as long as may be necessary to fulfil the purposes for which it was collected, including compliance with legal, regulatory, audit, risk management, dispute resolution and record-keeping requirements, in accordance with applicable laws and its Privacy Notice.

17. License and Access to the Platform
You acknowledge and agree that Truhome Finance Limited and/or its licensors, and service providers own all rights, title, and interest, including intellectual property rights, in and to the Platform, the Services and all related content, whether registered or unregistered. Such rights include, without limitation, copyrights, trademarks, trade names, service marks, patents, designs, trade secrets, databases, and proprietary information.
You further acknowledge that certain information made available through the Platform may be confidential and proprietary to Truhome Finance Limited, its licensors, or service providers. You agree not to disclose, reproduce, distribute or otherwise use such information except as expressly permitted by Truhome Finance Limited or applicable law.
All content available on the Platform, including but not limited to text, graphics, images, photographs, illustrations, logos, trademarks, icons, audio, video, software, source code, user interfaces, design elements, layout, functionality and the overall "look and feel" of the Platform, is owned by or licensed to Truhome Finance Limited and is protected under applicable intellectual property and other laws.
Subject to these Terms, Truhome Finance Limited grants you a limited, non-exclusive, non-transferable, revocable, and personal license to access and use the Platform solely for lawful purposes and for availing the Services offered by Truhome Finance Limited. 
Unless expressly permitted by Truhome Finance Limited in writing, this license does not permit you to:

•    Download, copy, reproduce, distribute, transmit, display, publish, or commercially exploit any content available on the Platform;
•    Modify, adapt, translate, create derivative works from, reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying technology of the Platform;
•    Sell, lease, assign, sublicense, transfer, or otherwise grant any rights in relation to the Platform or its content to any third party;
•    Use the Platform in any manner that infringes the rights of Truhome Finance Limited or any third party.

Any unauthorized use of the Platform or its content shall result in the immediate termination of the license granted under these Terms and may result in legal action.

18. Restrictions on Use

•    By accessing or using the Platform, you agree that you shall not:
•    Use the Platform or any content available on it for any unlawful, unauthorized or commercial purpose;
•    Submit any false, inaccurate, misleading or fraudulent information;
•    Access, monitor, extract, copy or scrape any content, data or information from the Platform through automated means, including robots, spiders, crawlers, bots, scripts or similar technologies, without prior written authorization from Truhome Finance Limited;
•    Circumvent, disable or interfere with any security feature, access control mechanism or technical safeguard implemented on the Platform;
•    Introduce viruses, malware, malicious code or any other harmful technology that may affect the functionality, security or integrity of the Platform;
•    Take any action that imposes an unreasonable or disproportionately large burden on the Platform, its systems, infrastructure or networks;
•    Frame, mirror, deep-link or otherwise incorporate any part of the Platform into another website, application or service without the prior written consent of Truhome Finance Limited;
•    Interfere with or disrupt the operation of the Platform, its servers, networks or related infrastructure; or
•    Use the Platform in a manner that violates any applicable law, guideline or third-party right.

Truhome Finance Limited reserves the right to suspend, restrict or terminate access to the Platform, without prior notice, in the event of any actual or suspected violation of these Terms or applicable law.

19. Privacy Policy 
By using the Website, you hereby consent to the use of your information as we have outlined in the Company’s Privacy Policy. The Privacy Policy explains how Truhome Finance Limited treats your personal information when you access the Website, avail any of the services/or ancillary Services.

20. Registration and Account
By accessing, registering on, or using the Platform, you represent and warrant that you are legally competent to enter into a binding agreement under applicable laws and are not prohibited from accessing or using the Services under any applicable law, regulation, or judicial order. You further agree to use the Platform and Services only for lawful purposes and, where acting on behalf of another person, represent that you are duly authorized to do so and have informed such person of the applicable terms, conditions, and privacy provisions governing the use of the Platform.

You acknowledge and agree that certain Services may require registration and the creation of an account. You are responsible for ensuring that all information provided during registration and thereafter is true, accurate, complete and up to date.

You shall be solely responsible for maintaining the confidentiality and security of your login credentials, including your username, password, One-Time Password (OTP), mobile number and any other authentication information associated with your account ("Account Credentials"). You agree not to disclose your Account Credentials to any third party and to take all reasonable precautions to prevent unauthorized access to your account.

You shall be responsible for all activities conducted through your account, whether authorized by you or otherwise. Accordingly, you are advised to log out of your account at the end of each session and ensure that your Account Credentials remain secure at all times.

You agree to notify Truhome Finance Limited immediately upon becoming aware of any unauthorized access to, use of, or security breach relating to your account. Subject to applicable law, Truhome Finance Limited shall not be liable for any loss, damage or unauthorized activity arising from your failure to safeguard your Account Credentials or comply with these Terms.

You undertake to provide and maintain accurate, current and complete registration and account information and to promptly update any changes thereto. You acknowledge that the accuracy of such information is essential for the provision of Services, customer communication, regulatory compliance, verification processes and account administration.

You agree not to:

•    Impersonate any person or entity or falsely represent your identity or authority;
•    Provide false, inaccurate, misleading or incomplete information;
•    Create or operate an account for any unlawful or unauthorized purpose;
•    Attempt to gain unauthorized access to the Platform, systems, networks, databases or accounts of other users;
•    Use the Platform or Services in any manner that violates applicable laws, regulations, or the rights of any third party.

Certain Services offered through the Platform may be subject to additional product-specific terms, conditions, disclosures, consents or agreements. By availing such Services, you agree to be bound by the applicable additional terms and conditions, which shall be read together with and form an integral part of these Terms of Use.

21. KYC and Customer Due Diligence
You acknowledge and agree that, for the purpose of providing Services through the Platform, Truhome Finance Limited may undertake customer identification, verification, and due diligence measures, including Know Your Customer ("KYC") checks, as required under applicable laws and regulations, including the Prevention of Money Laundering Act, 2002 ("PMLA"), and the rules, regulations, and guidelines issued thereunder from time to time.
You agree to provide such information, declarations, records and supporting documents as may be required by Truhome Finance Limited to verify your identity, address, source of funds, eligibility, and any other information required for onboarding, processing of applications, provision of Services, regulatory compliance or risk assessment purposes.
You further acknowledge and agree that Truhome Finance Limited may collect, verify, validate and obtain information from you and/or from authorized third-party sources, government databases, regulatory authorities, financial institutions, credit bureaus, service providers and other permissible sources, as may be necessary to establish and verify your identity and assess the nature and purpose of your relationship with Truhome Finance Limited.
You consent to Truhome Finance Limited undertaking such customer due diligence, ongoing monitoring, and enhanced due diligence measures as it may consider necessary to comply with its legal and regulatory obligations, including obtaining additional information, documentation, declarations or clarifications where required.
You understand that Truhome Finance Limited reserves the right to decline, suspend, restrict, or discontinue any application, account or Service if the information or documentation requested for KYC, due diligence, or regulatory compliance purposes is not provided, cannot be verified, or is otherwise found to be unsatisfactory in accordance with applicable laws, regulations and internal policies.

22.Eligibility
You declare and confirm that you are a resident of India, above 18 (Eighteen) years of age, and have the capacity to contract as specified under the Indian Contract Act, 1872, while availing the Services offered by Truhome Finance Limited.

23. User Content and Submissions
I/We acknowledge and agree that any information, data, documents, declarations, feedback, comments, suggestions, communications or other material submitted, uploaded, shared or otherwise made available by me/us through the Platform ("User Content") shall be my/our sole responsibility. I/We represent and warrant that I/we have all necessary rights, permissions and authorizations to provide such User Content.

I/We understand that Truhome Finance Limited shall not be responsible for verifying the accuracy, completeness or legality of any User Content submitted by me/us and shall not be liable for any loss or damage arising from such User Content.

By submitting or making available any User Content through the Platform, I/we authorize Truhome Finance Limited to collect, store, process, use, reproduce, modify, transmit and disclose such User Content solely for the purposes of processing my/our application, providing services, complying with legal and regulatory requirements, improving customer experience, and exercising its rights and obligations under applicable law. Such processing shall be undertaken in accordance with applicable data protection and privacy laws.

I/We further acknowledge and agree that any feedback, suggestions, recommendations or ideas provided by me/us regarding the Platform or Services may be used by Truhome Finance Limited without any obligation to compensate me/us.

I/We agree that I/we shall not upload, post, transmit, share or otherwise make available through the Platform any content that:

Is unlawful, fraudulent, misleading, defamatory, abusive, threatening, harmful or otherwise objectionable;
Violates the privacy, confidentiality, intellectual property or other legal rights of any person or entity;
Contains viruses, malware or other harmful code intended to disrupt or impair the Platform or related systems; Contains unauthorized advertisements, solicitations, promotional materials or spam; Impersonates any person or entity or misrepresents any affiliation, authorization or identity; Violates any applicable law, regulation, regulatory guideline, or contractual obligation.

I/We acknowledge that I/we shall be solely responsible for any User Content submitted by me/us and for any consequences arising from such submission. I/We agree to indemnify and hold harmless Truhome Finance Limited, its directors, officers, employees, affiliates, agents, and service providers against any claims, losses, damages, liabilities, costs, or expenses arising out of or in connection with any User Content submitted by me/us or any breach of these Terms by me/us.

Truhome Finance Limited reserves the right, at its sole discretion and without prior notice, to review, remove, restrict, or disable access to any User Content that it reasonably believes may violate these Terms, applicable law or the rights of any person or entity.

24. Third-Party Links and External Resources
The Platform may contain links to third-party websites, applications, services, content, or other resources that are not owned, controlled, managed, or operated by Truhome Finance Limited. 
I/We acknowledge and agree that Truhome Finance Limited has no control over, and is not responsible for, the availability, accuracy, content, security, privacy practices, products, services, or other materials available on or through any such third-party websites or resources. The inclusion of any link on the Platform shall not be construed as an endorsement, recommendation, or approval by Truhome Finance Limited of such third-party website, resource, product, or service.
I/We further acknowledge and agree that access to and use of any third-party website, application, product or service shall be entirely at my/our own risk and shall be subject to the terms, conditions, and privacy policies applicable to such third party.
Truhome Finance Limited shall not be liable or responsible, directly or indirectly, for any loss, damage, liability, cost, or expense arising from or relating to:
The availability or unavailability of any third-party website or resource;

•    Any content, information, advertisement, product, or service available through a third-party website or resource;
•    Any reliance placed by me/us on information obtained from a third-party website or resource;
•    Any transaction, interaction or relationship between me/us and any third party; or
•    Any act, omission, error, misrepresentation, breach, negligence, fraud, or default on the part of any third party.

I/We acknowledge that any dealings, transactions, correspondence, or participation in offers, promotions, or services provided by third parties shall be solely between me/us and the respective third party. Truhome Finance Limited shall not be responsible for any personal injury, financial loss, data loss, property damage, claims, disputes, or other consequences arising from such dealings or interactions.

25. Marketing Agents
Truhome Finance Limited may engage authorized agents, business partners, and service providers to promote its products and services and assist customers with enquiries, applications, and related services.

I/We acknowledge and agree that such authorized representatives may contact me/us and assist in connection with Truhome Finance Limited's products, services, and loan applications. All such activities shall be carried out in accordance with applicable laws and Truhome Finance Limited's policies.

I/We further understand that Truhome Finance Limited may share relevant information with its authorized agents and service providers on a need-to-know basis for the purpose of providing services, processing applications, and customer support.

26.Disclaimer & Warranties
I/We expressly acknowledge and agree that my/our access to and use of the Platform, Services, and any related information, content, products, or facilities provided through the Platform is at my/our sole risk. The Platform and Services are provided on an "as is" and "as available" basis without any representation, warranty, or guarantee of any kind, whether express, or implied.
Truhome Finance Limited does not warrant or guarantee the accuracy, adequacy, reliability, completeness, availability, or timeliness of any information, content, materials, products, or services made available through the Platform, including information provided by third parties. To the maximum extent permitted by applicable law, Truhome Finance Limited disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Truhome Finance Limited, its service providers, business partners and authorized representatives do not warrant that:

•    The Platform or Services will meet my/our requirements or expectations;
•    Access to the Platform or Services will be uninterrupted, secure, timely, or error-free;
•    Any information or results obtained through the Platform will be accurate, complete, or reliable;
•    Any errors, defects, or interruptions in the Platform or Services will be corrected; or
•    The Platform will be free from viruses, malware, or other harmful components.

27. Product Information and Pricing
Any information relating to products, services, facilities, interest rates, charges, features, benefits, eligibility criteria, or other offerings displayed on the Platform is provided for general informational purposes only and may be modified, updated, or withdrawn by Truhome Finance Limited at any time without prior notice.
Where any products or services are offered through business partners, or third-party service providers, such products, and services may be subject to additional terms, conditions, and pricing prescribed by the relevant provider.

28. Fees and Charges
Truhome Finance Limited may offer access to certain features, products or services free of charge or on payment of applicable fees and charges. Truhome Finance Limited reserves the right to introduce, revise, modify, or discontinue any fees, charges, or pricing structure from time to time, subject to applicable laws, and regulatory requirements. Any such changes shall become effective upon publication on the Platform or communication to users, as applicable.

29.Payment Services
For facilitating payments, Truhome Finance Limited may engage authorized payment gateway service providers, banks, financial institutions and other third-party payment facilitators approved under applicable laws and regulations. All payment transactions shall be processed through such authorized channels and shall be subject to the terms and conditions of the relevant payment service provider, bank or financial institution.

30. No Liability for Payment Failures
I/We acknowledge and agree that Truhome Finance Limited shall not be responsible or liable for any loss, damage, delay or failure arising from:

•    Unauthorized payment transactions;
•    Payment processing failures or disruptions;
•    Incorrect payment information provided by me/us;
•    Fraudulent or unauthorized use of payment instruments;
•    Rejection, decline or failure of a payment transaction by any bank, financial institution, payment gateway or third-party service provider; or
•    Any technical, operational or system-related issue affecting payment processing.

Truhome Finance Limited reserves the right to undertake additional verification checks and may suspend, reject or cancel any transaction where it reasonably believes that such transaction may involve fraud, unauthorized activity, security concerns or a violation of applicable law.

31. User Responsibility
I/We agree to provide accurate, complete and current information in connection with any application, transaction or payment made through the Platform. I/We further represent and warrant that any payment instrument, account or payment method used by me/us is lawfully owned or authorized for use by me/us.

32. Limitation of Liability
To the maximum extent permitted under applicable law, Truhome Finance Limited shall not be liable for any direct, indirect, incidental, consequential, special, punitive or exemplary loss, damage, cost or expense arising out of or in connection with:

•    Access to or use of the Platform;
•    Inability to access or use the Platform;
•    Reliance on information available through the Platform;
•    Any delay, interruption or failure in the provision of Services;
•    Any act, omission or default of third-party service providers;
•    Any loss of data, business opportunity, revenue, profits or goodwill.

I/We expressly acknowledge and agree that Truhome Finance Limited, including its affiliates, subsidiaries, directors, officers, employees, agents, service providers and authorized representatives, shall not be liable for any direct, indirect, incidental, special, consequential, punitive or exemplary loss, damage, cost or expense, including but not limited to loss of profits, business opportunities, revenue, goodwill, data, reputation or other intangible losses, arising out of or in connection with:
Any interruption, delay, suspension, defect or failure in the operation of the Platform or Services;
My/our access to, inability to access, or use of the Platform, Services or any content made available through the Platform;
Any act, omission, error, negligence or default by any third-party service provider, business partner, payment service provider or other third party;
Any unauthorized access to, alteration of, or use of my/our information or account;
Any virus, malware, corruption of data or other harmful technology affecting my/our devices, systems or data arising from the use of the Platform; or
Any reliance placed by me/us on information, content or materials available through the Platform.

The foregoing exclusion of liability shall apply even if Truhome Finance Limited has been advised of the possibility of such losses or damages.
To the fullest extent permitted by applicable law, if Truhome Finance Limited is held liable for any proven loss or damage arising directly from its gross negligence or wilful misconduct, the aggregate liability of Truhome Finance Limited shall be limited to the amount of fees, if any, actually paid by me/us to Truhome Finance Limited in connection with the specific Service or transaction giving rise to such claim.
I/We further acknowledge and agree that Truhome Finance Limited does not own, control or operate third-party websites, applications, products or services that may be linked to or accessible through the Platform. Accordingly, Truhome Finance Limited shall not be responsible or liable for any loss, damage, claim, liability, expense or consequence arising from my/our use of, reliance upon, or interaction with any such third-party websites, products or services.
Nothing contained in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law.

33. Availability of Services
While Truhome Finance Limited shall endeavour to provide uninterrupted access to the Platform and Services, Truhome Finance Limited does not guarantee continuous availability and shall not be liable for any interruption, delay, suspension or discontinuance resulting from maintenance activities, technical failures, regulatory requirements, force majeure events or circumstances beyond its reasonable control.

34. Geographic Restrictions
The products and services offered through the Platform are intended for use within India and may be subject to territorial, regulatory and operational limitations. Truhome Finance Limited reserves the right to restrict, suspend or discontinue access to any product, service or feature in any location or jurisdiction at its discretion and in accordance with applicable law.

35. Indemnity
You agree to indemnify and hold Truhome Finance Limited (and its affiliates, officers, directors, agents and employees) harmless from any and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including reasonable attorneys' fees, or arising out of or related to your breach of this T&C, your violation of any law or the rights of a third party, or your use of the Website. 
You shall not sue or otherwise make or present any demand or claim, and irrevocably, unconditionally and entirely release, waive and forever discharge Truhome Finance Limited, its officers, directors, employees, agents, licensees, affiliates, successors and assigns, jointly and individually (hereinafter "Release"), from any and all manner of liabilities, claims, demands, losses, claims, suits, costs and expenses (including court costs and reasonable attorney fees) ("Losses"), whatsoever, in law or equity, whether known or unknown, which you ever had, now have, or in the future may have against the Release with respect to the Services. You agree to defend, indemnify, and hold harmless the Release from and against any and all Losses resulting from claims made against Truhome Finance Limited by third parties arising from and in connection with this Authorization.

36. Additional Terms and Conditions
Truhome Finance Limited reserves the right to modify, amend, update or replace the Platform, these Terms of Use, the Privacy Policy, consent declarations and any related policies, notices or agreements at any time, as may be considered necessary, including for the purposes of complying with applicable laws and regulations, correcting inaccuracies, or omissions, improving the Platform or Services, reflecting changes in business operations, market practices or customer requirements.

Any such changes shall become effective upon being published on the Platform or communicated through any other appropriate mode. I/We acknowledge and agree that my/our continued access to or use of the Platform and Services after such changes are notified shall constitute my/our acceptance of the revised terms. If I/we do not agree to any modifications, I/we may discontinue the use of the Platform and Services.

Truhome Finance Limited reserves the right to suspend, restrict, modify, withdraw, or discontinue, either temporarily, or permanently, any part of the Platform, Services, or related features at any time, with, or without prior notice, where considered necessary for operational, security, legal, regulatory, maintenance or business reasons. To the extent permitted under applicable law, Truhome Finance Limited shall not be liable for any loss or inconvenience arising from such suspension, modification or discontinuance.

I/We agree not to use the Platform or Services for any unlawful, fraudulent, harmful, or prohibited purpose, including the transmission, publication, or distribution of any content that is illegal, defamatory, misleading, abusive, threatening, obscene, invasive of privacy, or otherwise violates the rights of any person or applicable law.

From time to time, Truhome Finance Limited may introduce promotional offers, campaigns, benefits, rewards, discounts, or other marketing initiatives ("Promotional Offers") in relation to its products and services. Such Promotional Offers may be subject to separate terms and conditions, eligibility criteria and limitations. In the event of any inconsistency between these Terms and the terms governing a Promotional Offer, the terms of the relevant Promotional Offer shall prevail to the extent of such inconsistency.

Truhome Finance Limited reserves the right, at its sole discretion, to modify, extend, withdraw, suspend or discontinue any Promotional Offer, in whole or in part, at any time, and without assigning any reason, subject to applicable law.

37. General
If any provision of these Terms is determined by a court, tribunal or competent authority to be invalid, illegal, or unenforceable, such provision shall, to the extent of such invalidity, illegality or unenforceability, be deemed severable from these Terms and shall not affect the validity, legality or enforceability of the remaining provisions, which shall continue in full force and effect.

I/We agree that the invalidity or unenforceability of any provision shall not affect the interpretation or enforcement of the remaining provisions of these Terms. The parties intend that any invalid or unenforceable provision be interpreted and enforced, to the maximum extent permissible under applicable law, in a manner that most closely reflects its original intent.

The headings and titles used in these Terms are inserted solely for convenience and reference purposes and shall not affect the meaning, interpretation, or scope of any provision of these Terms.

38. Jurisdiction, Governing laws, and Dispute Resolution 
These Terms of Use and any rights, obligations, or relationship arising out of or in connection with the access to and use of the Platform shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.
I/We acknowledge and agree that the Platform and Services are intended for use within India and shall be subject to applicable Indian laws, rules, and regulations.
Any dispute, claim, difference, or controversy arising out of or relating to these Terms of Use, the Platform, the Services, or any matter connected therewith shall be subject to the exclusive jurisdiction of the competent courts at Mumbai, Maharashtra, India.
No failure or delay by Truhome Finance Limited in exercising any right, power, or remedy under these Terms shall operate as a waiver of such right, power or remedy, nor shall any single or partial exercise thereof preclude any other or further exercise of the same or any other right, power or remedy.
These Terms of Use, together with the Privacy Policy, consent declarations, disclaimers and any other policies or terms referenced herein, constitute the entire agreement between I/we and Truhome Finance Limited with respect to the access to and use of the Platform and Services, and supersede all prior discussions, communications, representations, understandings or agreements, whether oral or written, relating thereto.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to remain valid and enforceable to the fullest extent permitted under applicable law.

39. Loan Application
I/We understand that submission of this application or enquiry form does not constitute approval, sanction, commitment, or disbursal of any loan.
I/We acknowledge that all loan products, schemes, benefits, offers, interest rates, loan amounts, tenures, repayment options, and funding limits displayed are indicative and subject to change without prior notice.
I/We understand that any "Instant Approval", "Quick Approval", "In-Principal Approval" or similar indication is preliminary in nature and shall not be construed as final loan approval or sanction.
I/We agree that the final sanction of the loan, loan amount, tenure, interest rate, disbursal and other terms shall be determined solely by Truhome Finance Limited based on its internal policies, credit assessment and verification process.

40. Eligibility and Verification
I/We represent that all information, documents and declarations provided by me/us are true, accurate, complete and up to date.
I/We agree to provide any additional information or documents that may be required for processing the application.
I/We understand that Truhome Finance Limited may verify the information furnished by me/us through such sources as may be deemed appropriate.
I/We acknowledge that submission of inaccurate, misleading, or incomplete information may result in rejection of the application or cancellation of any loan offer.

41. Credit Assessment
I/We authorize Truhome Finance Limited to undertake credit appraisal, risk assessment, due diligence, and background verification in connection with my/our application.
I/We authorize Truhome Finance Limited to obtain and verify information relating to my/our credit history, repayment track record, employment, residence, income, banking relationships, and other relevant details from credit bureaus, financial institutions, employers, service providers, and other legally permissible sources.
I/We understand that loan approval shall be subject to satisfactory verification and credit evaluation by Truhome Finance Limited.

42. Property-Related Conditions
I/We understand that financing of any property shall be subject to legal, technical, and valuation assessment conducted by or on behalf of Truhome Finance Limited.
I/We acknowledge that acceptance of a property for financing shall be at the sole discretion of Truhome Finance Limited and subject to applicable laws and internal policies.
I/We understand that any indicative property eligibility criteria are subject to verification and may vary based on Truhome Finance Limited's product guidelines.

43. Security Measures
I/We acknowledge that Truhome Finance Limited shall implement reasonable technical, organizational and administrative safeguards to protect personal data against unauthorized access, disclosure, alteration, misuse, loss or destruction.

44. Amendments
I/We understand that these Terms & Conditions may be amended, modified or updated from time to time and such revised Terms & Conditions shall become effective upon publication or communication by Truhome Finance Limited.

Consent Declaration 
I/We have read, understood and agree to the Terms & Conditions and Privacy Notice. I/We consent to the collection, processing, storage, and sharing of my/our personal data for the purposes of loan processing, credit assessment, customer servicing, fraud prevention, regulatory compliance, and related business purposes. I/We authorize Truhome Finance Limited, its affiliates, partners, service providers, and authorized representatives to contact me/us via call, SMS, email, WhatsApp, and other electronic channels regarding my/our application, products, and services. I/We further authorize Truhome Finance Limited to make enquiries regarding my/our credit history and obtain information from credit bureaus and other legally permissible sources.
